What type of information we hold
We hold personal data for marketing purposes such as email addresses and names in addition to personal data we hold about our employees, suppliers and existing customers and website user statistics.
How we obtain the information and why we have it
AGD is an advertising, design and marketing company which amongst other matters helps customers market their businesses. When we host and manage advertising campaigns for companies and their partners or other companies for whom we work, we collect data such as email addresses which we may check/verify as accurate for those companies and pass the data to them. We aim to tell you to whom we pass the data in each case. In some cases SAP SE (“SAP”) funds our work and either your data is passed to or shared with SAP or just with SAP’s collaborative partner via our secure platform. We will always specify on our consent statements with whom your data will be shared, and it will always be shared securely.
Where we gather data necessary for our relationship with our employees or contracts with our customers’ and suppliers’ data will be obtained due to legal and contractual obligations.
Where we gather data for marketing purposes this is processed based on your consent. You are given an express opt in and you can withdraw your consent at any time by emailing us at design@agdltd.com.. We will then suppress your details from any future marketing and at any company to whom we have passed the data within 30 days and then services to you based on the provision of that data may cease if the data is needed for those services. We may have to continue to hold the data in such a case for legal reasons.
Under the Data Protection Act 2018 and General Data Protection Regulation the lawful bases we rely on for processing this information are:
(a) Your consent. You are able to remove your consent at any time. You can do this by contacting us as stated above. This applies to marketing data
(b) We have a contractual obligation. For supplier, customer and employee data.
(c) We have a legal obligation. For supplier, customer and employee data
(d) We have a vital interest.
(e) We need it to perform a public task.
(f) We have a legitimate interest. For supplier, customer and employee data.
What we do with the information
Your data will be used for marketing purposes where you have expressly opted into this and this will include passing your data to our approved partners such as SAP SE and contacting you by telephone or email including via LinkedIn to verify with you your contact details.
To the extent the data is sent outside the UK you consent to this and/or we have a written agreement protecting such data under UK/EU model clauses for data export, but you may withdraw that consent at any time by emailing us at the address above.
We also store employee and supplier/customer data for general business purposes.
We do not use your data for any profiling nor do we use automated decision making in relation to the data.
How we store your information.
We keep marketing data safely on our servers and/or on those of our partners such as SAP SE and in our/their back up servers in electronic form. We keep this data for as long as is necessary for the purpose for which the data is gathered. Once the data is no longer needed we destroy it securely on our systems. If you ask for it to be destroyed we will delete it earlier save in so far as the law requires us to keep the data for legal reasons in which case we will suppress the data from further marketing.
Your data protection rights
Under data protection law, you have rights including:
Your right of access - You have the right to ask us for copies of your personal information.
Your right to rectification - You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete.
Your right to erasure - You have the right to ask us to erase your personal information in certain circumstances.
Your right to restriction of processing - You have the right to ask us to restrict the processing of your information in certain circumstances.
Your right to object to processing - You have the the right to object to the processing of your personal data in certain circumstances.
Your right to data portability - You have the right to ask that we transfer the information you gave us to another organisation, or to you, in certain circumstances.
You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you.

If your personal data changes you can also contact us to update/correct your data. If we hold your data for the purposes of your being an employee, supplier or customer of ours we process your data based on our legitimate interests and contract bases and your right of data deletion does not then apply as we need your data to perform our duties to you.
